PREAMBLE

These General Terms and Conditions of Sale (T&Cs) govern all sales of products and services, including subscriptions, made by Maalmy. to any consumer via the website www.maalmy.com, operated on the Shopify platform.

By placing an order on the website, you fully accept these T&Cs.

ARTICLE 1 – PRODUCTS AND SERVICES

Maalmy. offers scar care products available in several packages:

Prices are displayed in South African Rand (ZAR). Visuals and descriptions are provided for illustrative purposes only. Minor variations may exist depending on the screen used.

ARTICLE 2 – SUBSCRIPTION AND RECURRING BILLING

2.1 How the subscription works

⚠️ IMPORTANT NOTICE: Maalmy. offers its products with an optional subscription plan involving automatic and recurring monthly billing. On the product page, the box "Subscribe and save 20%" is checked by default. By confirming your order without unchecking this box, you are subscribing to a plan that renews automatically every month.

2.2 Subscription pricing

The following prices apply under the monthly subscription plan:

1-month treatment: R 559,00/month (instead of R 699,00)
2-month treatment: R 1 119,00/month (instead of R 1 399,00)
3-month treatment: R 1 679,00/month (instead of R 2 099,00)

2.3 Automatic renewal

Your subscription is automatically renewed at each monthly billing date, unless you cancel before the renewal date.

💡 To avoid being charged: uncheck the "Subscribe and save 20%" box before adding to cart. If the box remains checked, your payment method will be charged automatically every month.

2.4 How to cancel your subscription

You may cancel your subscription at any time, free of charge and without penalty, in two ways:

From your customer account: My Account > Manage my subscription > Cancel subscription
By email: Contact@maalmy.com — please include your order number

✅ Cancellation takes effect immediately. No further charges will be made after cancellation. Your access and current monthly period remain active until the end of the billing cycle.

ARTICLE 3 – ORDERS

By validating your order, you accept these T&Cs and, where applicable, the monthly recurring subscription. A confirmation email will be sent to you once payment is validated.

Maalmy. reserves the right to refuse any order for legitimate reasons (abnormal order, ongoing dispute, etc.).

ARTICLE 4 – PRICES AND PAYMENT

All prices are displayed in South African Rand (ZAR, R) and are inclusive of applicable taxes. Delivery is free for all subscription orders.

By subscribing, you authorise Maalmy. to automatically charge the applicable amount to your payment method at each monthly billing date. Prices applicable are those in effect at the time the order is placed.

ARTICLE 5 – SHIPPING AND DELIVERY

Delivery timeframes displayed on the website are estimates and do not constitute a firm commitment. Maalmy. cannot be held liable for delays caused by the carrier or by events beyond its control (force majeure, strikes, weather conditions, customs, etc.).

Risk of loss transfers to the Customer upon handover of the parcel to the carrier.

ARTICLE 6 – RIGHT OF WITHDRAWAL

You have the right to withdraw from your purchase within 14 calendar days from the date of receipt of your order, without giving any reason and without penalty.

To exercise this right, send an email to Contact@maalmy.com with your order number. Refunds will be processed within 14 days of receiving your withdrawal request.

⚠️ The right of withdrawal does not apply to digital content for which delivery has already begun with your prior express consent.

ARTICLE 7 – LEGAL WARRANTIES

All products are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with applicable consumer protection legislation.

ARTICLE 8 – RETURNS AND REFUNDS

All return or refund requests must be sent to Contact@maalmy.com within the applicable timeframes. Outside the legal withdrawal period, refunds are granted at Maalmy.'s discretion based on the nature of the product and the circumstances.

ARTICLE 9 – LIABILITY

Maalmy. shall not be liable for any indirect damages or consequential losses arising from the use of its products or services. Maalmy.'s liability is limited to the amount paid by the Customer for the order in question.

ARTICLE 10 – PERSONAL DATA PROTECTION

Personal data collected during your order is processed in accordance with our Privacy Policy and applicable data protection regulations. You have the right to access, correct, delete and port your data by contacting: Contact@maalmy.com.

ARTICLE 11 – INTELLECTUAL PROPERTY

All content on the Maalmy. website (texts, images, logos, etc.) is protected by intellectual property law. Any reproduction without prior written authorisation is strictly prohibited.

ARTICLE 12 – GOVERNING LAW AND DISPUTES

These T&Cs are governed by French law. In the event of a dispute, you may seek mediation or refer the matter to the competent court of your place of residence.
